1. Definitions

“HooYu” and “we” and “our”means HooYu Ltd of 5th Floor, Commonwealth House, 55-58 Pall Mall, London SW1Y 5JH  (company number: 07180348);
“GDPR” means the General Data Protection Regulation (Regulation (EU) 2016/679);
“personal data” means information that can be used to uniquely identify a single person, as defined under GDPR;
“website” means the website at www.hooyu.com;“you” means you as an individual and “your” and “yours” shall be interpreted accordingly.

2. About this document 

This Privacy Policy relates to personal data that you provide during your use of the website. It does not relate to personal data provided during use of the HooYu identity verification service which has its own privacy policy https://www.hooyu.com/legal/privacy-policy. This document sets out our responsibilities and your rights.

HooYu is committed to meeting and exceeding the data protection standards set out under GDPR, however, we are not perfect, and occasionally something may go wrong. Please be assured that we treat all questions or complaints very seriously and we always strive to achieve a satisfactory outcome.

4. Personal Data we collect

If you request a brochure or a call back, sign-up to a webinar, or subscribe to receive marketing messages, we will ask you to provide some, or all, of the following personal data:

• Name
• Email
• Phone number
• The organisation you represent

We will use this information solely to communicate with you about our products and services. We will not disclose your personal data to any other person or organization except HooYu employees, companies acting as data processors on HooYu’s behalf, and as required by law. Data processors acting on HooYu’s behalf may only use the information in accordance with HooYu’s instructions.

5. Legal basis for processing 

Under GDPR we must have a legal basis upon which to process your personal data. The legal basis is Article 6(1)(f) of the GDPR, which allows us to process personal data when it is necessary for the purposes of our legitimate interests. This is subject to a balancing test to ensure our interests are not overridden by your fundamental rights.

6. Your rights 

All marketing emails that you receive from us will include an “unsubscribe” link which, if clicked, instructs us not to send any further emails.

You also have the following legal rights under GDPR:

  • The right to withdraw consent (though please note that we do not rely upon consent to process your personal data).
  • The right to erasure – you can request that we remove your personal data from our systems.
  • The right to restrict processing – you can request that we only process your personal data for the purposes you specify.
  • The right to data portability – you can request that the personal data you have provided to us be ported to another organisation.
  • The right to access your personal data – You have a right to know what personal data HooYu holds on you and for what purpose we are processing your personal data. This is known as a Subject Access Request (SAR).
  • The right to rectification – you have the right to ask us to rectify any information you believe is inaccurate. You also have the right to ask us to complete information you think is incomplete.
  • The right to object to processing – you have the right to object to us processing your personal data.
  • The right to obtain information upon request on the balancing test we have carried out when determining we are able to rely on legitimate interest as our lawful basis for processing your personal data.

Please note that some of these rights are subject to our assessment as to whether we have a continuing legal basis upon which to process your data.

7. Use of cookies 

We use cookies. A cookie is a text file containing small amounts of information that will be downloaded to your computer when you use the website. Cookies do not contain personal data though some of them can only be useful if associated with your personal details. Cookies do lots of jobs and are a commonplace tool used by most websites. 8. Transfers outside the UK and the European Economic Area

9. Data retention

We will retain your personal data for so long as we have a legal basis for doing so. We will cease marketing to you should we receive an unsubscribe request or should you otherwise request us to do so. 11. Your California privacy rights

If you are a California resident, California Civil Code Section 1798.83 permits you to request certain information regarding our use of information related to you. This portion of our Privacy Policy advises California residents of these rights and how to make requests under these rights.

Right to Deletion of Personal Data

California residents have the right to request the deletion of Personal Data as prescribed in Section 1798.105(a) of the CCPA. Exceptions to this right of deletion include, among others:

  2. Information that is used by Hooyu to detect and prevent fraudulent transactions and fraudulent use of Personal Data;
  3. Information that is used to deliver the Hooyu Service;
  4. Information that Hooyu is legally required to store, such as information that falls under a court order.

Hooyu may not always delete all requested Personal Data if permitted or required by applicable law. If you would like to exercise this right, please make a request using the details in the “How to Contact Us “ section below. In order to ensure the security of your Personal Data and prevent fraudulent requests, we may need to verify your identity.
